Maxim permanent terms (candidates)
Agency Terms of Business (Candidates) of Maxim Recruitment Limited (‘Maxim’) for Employment Agency services (recruitment of staff to be paid direct by Client) (May 2018 edition)

The introduction of candidates by an Employment Agency is governed by the Employment Agencies Act 1973 and regulations made under that Act.
These are the terms which will apply, in relation to the Employment Agency services which we will provide to you.

1. Our capacity will be that of an Employment Agency (ie if you are offered and accept an engagement, you will be paid directly by the Client); our terms of business for acting as an Employment business (where you would be engaged and paid by us) are available on request.

2. The type of work we will seek to find for you is in accordance with the general nature of the positions you have indicated your willingness to fill, and with your general skills and qualifications.

3. We are not permitted to make any charge to you for our Employment Agency services.

4. There are no other services or goods we may provide which are chargeable.

5. If a gift or incentive is offered to you to induce you to engage our services, before you can accept the offer we must first disclose all the terms to you.

6. We do not have authority to contractually bind you.

7. We are required by law to give you information about the personal data (including sensitive personal data / special category data) about you that we record, keep and process, and about the conditions under which we ensure our processing of such data is lawful. This information is contained in our Candidate Data Protection and Privacy Notice.

8. We may use any information you provide us with for the purpose of trying to find you work as you have requested, including (where appropriate) via Maxim Partner Companies and other agencies.

8.1. ‘Maxim Partner Company’ means a company which is a holding company, subsidiary or associate of Maxim Recruitment Ltd, and includes a company substantially in the same ownership as Maxim Recruitment Ltd.

8.2. HK Maxim Recruitment Ltd, incorporated in Hong Kong, is a Maxim Partner Company.

8.3. Maxim Recruitment Limited, incorporated in Canada, is a Maxim Partner Company.

9. Please note that all calls and emails to and from us may be monitored and recorded for legitimate purposes relating to our business.
It is your responsibility to give us sufficient information to enable us to provide our services, including

10. the identity of your current employer (as soon as possible, and promptly in the event of any change, to help us ensure that we do not accidentally provide that employer with your details);

11. confirmation of your identity and right to work in UK (as soon as possible);

12. confirmation of your requirements, training, experience, and qualifications (as soon as possible, and promptly in the event of any change);

13. confirming promptly on our request your willingness to work in any particular positions for which we wish to put you forward;

14. tell us promptly if you find a suitable position elsewhere and do not wish us to continue looking for a position for you;

15. providing us with any information that may reasonably be expected to affect the decision of a prospective employer to engage you;

16. ensuring that any CV you provide accurately and completely discloses your history and experience, and that any references are honest and accurate; and

17. where you would be required by law or by any professional body to hold any particular qualifications or authorisations to take up a position, you must also

17.1. provide us with copies of those qualifications or authorisations for us to pass on to the proposed employer, and

17.2. provide two references from persons who are not relatives and who are willing for those references to be passed on to the proposed employer.

18. If any engagement will involve working with or caring for or attending any person under the age of 18, or who by reason of age, infirmity or any other circumstances is in need of care or attention, you must also provide two references from persons who are not relatives and who are willing for those references to be passed on to the proposed employer.
You must not accept any offered engagement if you are in any way legally restricted from doing so.
